What Are The Levels Of Misdemeanor In Iowa?

In Iowa, misdemeanor offenses are divided into three distinct categories: simple misdemeanors, serious misdemeanors and aggravated misdemeanors.

Each level carries different penalties and implications, which can affect your criminal record, employment prospects and personal reputation. When you are preparing a defense strategy, it is essential to understand how your misdemeanor charges will be classified.

Simple misdemeanors are the least severe Iowa misdemeanor charges, typically involving minor infractions like disorderly conduct, trespassing or first-time domestic abuse assault without injury. Under Iowa Code section 701.8, any public offense not otherwise classified defaults to a simple misdemeanor. Penalties include a fine from $105 to $855 and up to 30 days in jail. While less serious, simple misdemeanor convictions can still result in a permanent criminal record and should be addressed with care.

Serious misdemeanors represent a mid-level offense and often involve more substantial harm or risk to others. Examples include first-offense operating while intoxicated (OWI), assault causing bodily injury and possession of a controlled substance. Penalties under Iowa Code §903.1(1)(b) include a fine between $430 and $2,560 and up to a year in county jail. Courts may also order probation or other conditions depending on the nature of the offense.

Aggravated misdemeanors are the most serious misdemeanor classification. They include second offense OWI, prostitution or indecent exposure. Per Iowa Code §903.1(2), penalties can include up to two years in prison and/or fines of $855 to $8,540. The court may also impose conditions like substance abuse treatment or community service. A conviction poses long-term consequences, including limitations on firearm ownership and increased penalties for future offenses.

If you are facing any level of misdemeanor charge in Iowa, it is important to seek legal guidance immediately. A skilled criminal defense attorney can help you understand the classification of your offense and build the most appropriate strategy.
